Plain-English Note: This is a legally binding agreement between you and Yarn World. We have written it as clearly as we can. If something is unclear, email us at info@yarnworldhaven.com before you place an order.
1. Acceptance of These Terms
By visiting yarnworldhaven.com, creating an account, or placing an order, you agree to be bound by these Terms of Service. If you do not agree, do not use this site or place an order.
These Terms apply to all visitors, customers, and others who access or use the site. They form a binding contract between you (you or Customer) and Yarn World (we, us, or Yarn World), a family-owned business based in Andover, Minnesota.
These Terms are governed by Minnesota law. The Minnesota Supreme Court has established that unambiguous contract terms are given their plain and ordinary meaning and read in the context of the entire contract. S O Designs USA, Inc. v. Rollerblade, Inc., Minn. Ct. App. (2000) (citing Turner v. Alpha Phi Sorority House, 276 N.W.2d 63, 67 (Minn. 1979)).
2. Who May Use This Site
You must be at least 18 years old, or using the site under the supervision of a parent or legal guardian who agrees to these Terms on your behalf. By placing an order, you represent that you meet this requirement.
We sell and ship within the United States only. Orders with shipping addresses outside the United States will not be accepted or fulfilled.
3. Order Acceptance and Our Right to Refuse Orders
3.1 When a Contract Is Formed
Placing an order on yarnworldhaven.com is an offer to purchase — it is not a confirmed sale. A binding contract between you and Yarn World is formed only when we send you an order confirmation email stating that your order has been accepted and is being processed.
An order confirmation email is distinct from a payment receipt. Receipt of payment alone does not constitute acceptance of your order.
3.2 Our Right to Refuse or Cancel Orders
We reserve the right to refuse, cancel, or limit any order at any time, for any lawful reason, including but not limited to:
- The item is out of stock or has been discontinued
- We identify an error in pricing or product description (see Section 4)
- We are unable to verify payment or billing information
- The order appears to be for commercial resale in a manner inconsistent with these Terms
- The shipping address is outside the United States
- A prior order from the same customer was fraudulent or resulted in a chargeback
If we cancel your order after payment has been collected, we will issue a full refund to your original payment method. We will notify you by email.
Minnesota's consumer protection framework under Minn. Stat. § 325F.69 (the Consumer Fraud Act) prohibits deceptive acts in connection with the sale of merchandise. Our order-refusal policy is designed to be exercised for legitimate operational reasons, not as a deceptive practice.
4. Pricing, Product Descriptions, and Availability Errors
4.1 Pricing Errors
We make every effort to display accurate prices. However, errors can occur. If an item is listed at an incorrect price due to a typographical error, system error, or error in pricing information received from a supplier, we reserve the right to cancel orders placed at the incorrect price, even after an order confirmation has been sent.
If such a cancellation occurs, we will:
- Notify you promptly by email
- Issue a full refund of any amount charged
- Offer you the opportunity to re-order at the correct price if you choose
We are not obligated to sell any item at an erroneous price.
4.2 Product Description Errors
We attempt to describe all products accurately. Colors displayed on screen may vary from actual product colors due to monitor settings and dye-lot variation in yarn. Yarn weights, yardage, fiber content, and gauge are provided by manufacturers and may vary slightly.
4.3 Availability
All products are offered subject to availability. We do not guarantee that any item displayed on the site is in stock at the time of your order. If an item becomes unavailable after your order is placed, we will notify you and offer a refund, a substitution (with your approval), or a backorder option.
5. Shipping
Full shipping terms are set out in our Shipping Policy. Key terms incorporated here by reference:
- Shipping rates are calculated at checkout based on your items and delivery address — the exact cost is shown before you pay
- Estimated delivery: standard 5–7 business days; expedited options (2–4 business days) where available
- We ship within the United States only
- Some orders may arrive in multiple packages where items ship directly from our partner suppliers
- Delivery estimates are not guarantees; carrier delays are outside our control
Risk of loss and title for items purchased pass to you upon delivery to the carrier.
6. Refunds and Returns
Our complete return and refund terms are set out in our Refund & Return Policy, which is incorporated into these Terms by reference. Key terms incorporated here:
- Returns accepted within 30 days of delivery for unused, unopened items in original condition
- Return process begins by emailing info@yarnworldhaven.com
- Digital downloads (PDF patterns) are non-refundable once downloaded or accessed
- Used or opened yarn cannot be returned due to dye-lot integrity and quality degradation
7. Digital Products — PDF Patterns: License Terms
7.1 What You Are Buying
When you purchase a downloadable PDF pattern from Yarn World, you are purchasing a limited personal-use license — not a transfer of ownership of the underlying copyright.
7.2 What You May Do
Your license permits you to:
- Download and print the pattern for your own personal, non-commercial use
- Make items from the pattern for personal use or as handmade gifts
- Make a reasonable number of personal backup copies of the file
7.3 What You May NOT Do
Your license expressly prohibits you from:
- Reproducing, copying, scanning, or distributing the pattern in any form — digital or print
- Sharing, uploading, or posting the file to any website, file-sharing platform, social media, group, or cloud service for others to access
- Selling items made from the pattern commercially without a separate commercial license (check the individual pattern page — some designers permit this; most do not)
- Reselling or sublicensing the pattern itself in any form
7.4 Legal Basis
PDF patterns are protected by federal copyright law under 17 U.S.C. § 101 et seq. (the Copyright Act of 1976). Unauthorized reproduction or distribution constitutes copyright infringement, which can give rise to statutory damages of 750 to 30,000 dollars per work infringed under 17 U.S.C. § 504(c)(1), and up to 150,000 dollars per work for willful infringement under 17 U.S.C. § 504(c)(2).
Minnesota law additionally prohibits the sale or distribution of counterfeited intellectual property. Minn. Stat. § 609.895 provides criminal penalties for intentionally manufacturing, producing, distributing, offering for sale, selling, or possessing with intent to sell or distribute any counterfeited item, with penalties reaching up to five years imprisonment and 100,000 dollars in fines for qualifying violations.
7.5 No Refunds on Digital Downloads
Because PDF patterns are delivered digitally and accessible immediately upon purchase, all digital download sales are final. No refunds will be issued once a file has been accessed or downloaded. See our Refund & Return Policy for full details.
8. Intellectual Property — Yarn World's Own Content
8.1 Ownership
All content on yarnworldhaven.com that originates with Yarn World — including but not limited to the store name, logo, product photography, written descriptions, blog posts, design elements, and the selection and arrangement of site content — is the intellectual property of Yarn World and is protected by federal and Minnesota law.
8.2 Third-Party Content
Patterns, images, and product content provided by third-party designers or suppliers remain the intellectual property of their respective owners. Yarn World uses such content under license or with permission.
8.3 Prohibited Uses
You may not, without our express written permission:
- Copy, reproduce, republish, or distribute any Yarn World content
- Use Yarn World's name, logo, or trademarks in any manner that implies endorsement or affiliation
- Frame or mirror any portion of this website
Minn. Stat. § 609.895 prohibits the use of another's trademark, service mark, or trade name without authorization. Violation constitutes a criminal offense under Minnesota law and may also give rise to civil liability.
9. Disclaimers
9.1 As-Is Disclaimer
THIS WEBSITE AND ALL PRODUCTS SOLD THROUGH IT ARE PROVIDED ON AN AS IS AND AS AVAILABLE BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YARN WORLD MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
Plain English: We believe in our products, but we cannot legally guarantee that every yarn will work for every project or that every tool will suit every crafter's needs. You are responsible for evaluating whether a product is right for your use before purchasing.
9.2 Allergen and Fiber Content Notice
Yarn fibers, dyes, and finishing agents may cause reactions in individuals with sensitivities. Fiber content information is provided by manufacturers. If you have known fiber allergies or sensitivities, please review all product descriptions carefully before ordering. We cannot guarantee the accuracy of manufacturer-supplied fiber content data.
9.3 Website Availability
We do not warrant that the website will be available at all times, free of errors, or free of viruses or harmful components. We reserve the right to modify or discontinue the site without notice.
10. Limitation of Liability
10.1 The Limit
TO THE FULLEST EXTENT PERMITTED BY MINNESOTA LAW, YARN WORLD'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS, YOUR USE OF THIS SITE, OR ANY PRODUCTS PURCHASED FROM US SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT OR ORDER GIVING RISE TO THE CLAIM, OR (B) $50.00.
10.2 Exclusion of Consequential Damages
TO THE FULLEST EXTENT PERMITTED BY LAW, YARN WORLD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, ARISING OUT OF YOUR USE OF THIS SITE OR ANY PRODUCTS PURCHASED FROM IT.
10.3 Legal Basis and Limits Under Minnesota Law
Minnesota courts enforce contractual liability limitations where two conditions are met: (1) no disparity of bargaining power that rises to unconscionability, and (2) the service is not one of essential public necessity requiring regulation (such as common carriers, hospitals, or utilities).
The Minnesota Supreme Court confirmed this two-prong framework in Schlobohm v. Spa Petite, Inc., 326 N.W.2d 920, 923 (Minn. 1982), as applied recently in Lund v. Calhoun Orange, Inc., No. A23-0149 (Minn. May 21, 2025): a provision shielding a party from liability for its own negligence is strictly construed and enforceable only when it clearly and unequivocally states that intent.
The Minnesota Court of Appeals applied this framework in Johanns v. Minnesota Mobile Storage, Inc. (Minn. Ct. App. 2006), enforcing a contractual damage cap and noting that exculpatory clauses are valid where they explicitly carve out fraud, willful injury, or willful violation of law.
Accordingly, our limitation of liability does NOT apply to:
- Fraud or intentional misrepresentation by Yarn World
- Willful injury
- Willful violation of law
- Any claims that cannot be limited under applicable Minnesota or federal consumer protection law
10.4 Essential Public Service Carve-Out
Retail yarn sales are not a public utility, common carrier, healthcare service, or essential public service. Accordingly, the Schlobohm public-service prong does not render our limitation of liability unenforceable on that basis.
11. Indemnification
You agree to indemnify, defend, and hold harmless Yarn World, its owners, employees, and agents from and against any claims, liabilities, damages, judgments, and costs (including reasonable attorneys' fees) arising out of:
- Your violation of these Terms
- Your violation of any third party's rights, including intellectual property rights
- Your misuse of any product purchased from Yarn World
- Any content you submit to us (reviews, comments, etc.)
12. Governing Law and Venue
12.1 Governing Law
These Terms of Service, and any dispute arising out of or relating to them or to any transaction with Yarn World, shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict-of-law provisions.
12.2 Venue
Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Anoka County, Minnesota (the county in which Andover is located). You consent to personal jurisdiction and venue in those courts.
12.3 Applicable Consumer Protection Law
Nothing in these Terms limits any rights you may have under:
- The Minnesota Consumer Fraud Act, Minn. Stat. § 325F.69
- The Minnesota Uniform Deceptive Trade Practices Act, Minn. Stat. § 325D.44
- The FTC Act, 15 U.S.C. § 45 (prohibiting unfair or deceptive acts or practices)
- Any other applicable state or federal consumer protection law that cannot be waived by contract
13. Changes to These Terms
We may update these Terms of Service at any time. When we do, we will:
- Post the revised Terms on this page
- Update the Last Updated date at the top of this page
- For material changes, provide notice by email or a prominent notice on the site
Your continued use of the site after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the site.
14. Severability
If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions shall continue in full force and effect.
15. Entire Agreement
These Terms of Service, together with our Refund & Return Policy, Shipping Policy, and Privacy Policy, constitute the entire agreement between you and Yarn World regarding your use of this site and any purchases made through it. They supersede all prior communications, representations, or agreements.
